February 12, 2014: The firm obtained summary judgment dismissing the Complaint in this action, wherein the plaintiff sought to be paid a collections bonus on a matter he was allegedly responsible for bringing to the firm. After discovery was conducted, including depositions of plaintiff and a number of representatives of the defendant, Justice Rosenbaum issued a Decision concluding that the collections bonus award was discretionary in nature and, therefore, no breach of contract claim could be maintained by plaintiff.
December 27, 2013: The firm obtained a reversal of a judgment granting the relief sought in the Article 78 Petition. The Petition challenged the Town of Victor Planning Board's authority to impose a recreation fee on a developer. The Court ruled that the lower court erred in concluding that The Planning Board could not set a recreation fee after the development had been built. This was the second time the firm obtained a reversal on appeal in this case. The first reversal occurred on August 20, 2010, in the case of Legacy at Fairways, LLC v. McAdoo, 76 AD3d 786 (4th Dep't 2010). Read the Decision

Firm obtains reversal of a conviction and dismissal of the indictment in a felony case. In People v. Cady, the Appellate Division ruled that the police had overstepped their bounds when they chased and tackled Mr. Cady without reasonable suspicion. Prior to her clerkship, Ms. Merkel practiced in Washington, D.C., where she served as in-house counsel for an international labor union and with an independent federal agency dealing with work-place safety.

In November 2010 it was announced that the goal of $235,000 has been surpassed.
